The MCCAA consumer complaint process: what to prepare

The MCCAA process is easier to use when your complaint already has a clear chronology, a specific requested remedy, and a short evidence index.

Before filing with the MCCAA

The MCCAA advises consumers to understand their rights, complain to the trader in writing, provide the relevant documents, seek an amicable agreement, and allow a reasonable time for a response.

Information to prepare

  • Your contact details and the trader's contact details.
  • Proof of purchase and the agreement, guarantee, or sales contract where relevant.
  • A concise description and timeline.
  • Copies of the complaint, follow-ups, and the trader's response or evidence of no response.
  • The remedy you are asking for.

What may happen after filing

According to the MCCAA, registered complaints are assessed and assigned to a complaint handler who attempts conciliation. If conciliation is unsuccessful, the consumer may refer the claim to the Consumer Claims Tribunal.

The MCCAA also describes Alternative Dispute Resolution as a free out-of-court mechanism involving a neutral third party. Both sides must agree to use it and may withdraw during the process.
